These terms set out how Kerb Digital works with you, what you can expect from us, and what we ask of you in return. They apply whenever you ask us to design, build or look after a website for you. If anything here is unclear, just ask and we will happily talk it through before you commit to anything.
1Who we are
Kerb Digital is a trading name of Rightbox Ltd, a company registered in England and Wales. Company number 12645057, registered office Creative Industries Centre, Glaisher Drive, University of Wolverhampton Science Park, Wolverhampton, West Midlands, WV10 9TG. Rightbox Ltd is VAT registered, VAT number 493 9681 28. You can reach us any time at hello@kerbdigital.com. In these terms, "we", "us" and "Kerb" mean Kerb Digital, and "you" means the person or business we are building the website for.
2What we do
We design and build websites, and we look after them once they are live. Depending on what you have chosen, that can include the website build itself, hosting, security, ongoing changes, and help getting found on Google. The exact things included in your project are the ones set out in your quote.
3Quotes and pricing
We will give you a clear quote before any work starts. Unless we say otherwise in writing, a quote is valid for 30 days. Prices are shown excluding VAT, which we add at the current rate.
Each project is quoted individually. A website is a one-off build fee plus a simple monthly care plan that covers hosting, security and changes. Your quote is the final word on what is included and what it costs.
4The free demo
For most projects we build a free demo first, so you can see the look and feel before you spend anything. The demo is there to help you decide. It is illustrative, it stays our property until you go ahead, and asking for a demo does not commit you to anything.
5Payment
- Build fees are payable as set out in your quote, which may include a deposit before we start.
- Monthly plans are billed monthly in advance and continue until you cancel.
- Invoices are due on receipt unless agreed otherwise.
- If payment is overdue we may pause work or, for monthly plans, suspend the service until the account is up to date.
6What we need from you
To build you a great site quickly, we need you to give us accurate information, any content or photos you want us to use, and timely feedback and approval when we ask for it. You confirm that you own, or have permission to use, anything you send us, including images, logos and text.
7Accuracy and honesty of content
You are responsible for making sure the business information you give us is true, including any accreditations, registrations, guarantees and reviews. We will not knowingly publish false or misleading claims, invented reviews or accreditations you do not hold. Keeping your website honest protects both of us.
8Changes and revisions
While your monthly plan is active, everyday changes such as new photos, prices, opening times or wording are included, and we will usually sort them the same working day. Larger pieces of work, extra pages or a redesign sit outside day-to-day changes and will be quoted separately before we begin.
9Hosting, care and cancellation
Hosting, security and ongoing changes are provided as part of an active monthly plan. You can cancel your monthly plan by giving us 30 days' notice in writing to hello@kerbdigital.com.
If your plan ends, hosting and the changes service stop. We will help you move your site elsewhere if you would like, and your domain remains yours to take with you.
10Ownership
Once your build fee has been paid in full, the finished website design and the content we have created for you are yours to keep. Your domain name is registered to you and belongs to you.
We keep ownership of any underlying code, tools, frameworks and techniques we reuse across projects. Unless you ask us not to, we may show your website in our own portfolio and marketing as an example of our work.
11Other companies' services
Some parts of your website rely on third-party services, for example hosting providers and web fonts. Those services have their own terms, and while we choose reliable providers, we are not responsible for outages or changes on their side that are outside our control.
12Getting found on Google
We build every site to be found locally and set it up on solid SEO foundations. Search rankings depend on many things outside our control, including your location, competition and how Google works, so we cannot promise a specific position or that you will rank number one. What we do promise is to build it properly and keep it maintained.
13Availability and liability
We take reasonable care to keep your site online and running well, but we cannot guarantee it will be available without interruption at all times.
Nothing in these terms limits our liability where it would be unlawful to do so. Otherwise, we are not liable for indirect or consequential losses, including lost profits or business, and our total liability to you is limited to the fees you have paid us in the 12 months before the claim.
14Your privacy
We only use the details you give us to provide our service and reply to your enquiries, and we do not sell your data. For more on how we handle personal data, see our privacy policy, or email us and we will explain.
15Changes to these terms
We may update these terms from time to time. The version published on our website is the one that applies, and the date at the top shows when it last changed.
16Law and contact
